The term “Make Me Smile Balloons and Events”, “us”, “our” or “we” refers to the owner of this website. The registered address is 55 Gillhurst Road, Harborne, Birmingham B17 9PD. The term “you” refers to the user or viewer of this website or customer having already entered into a contract with us via any other mechanism.

Orders made are subject to a 7 day ‘cooling off’ period from the date of booking. After that time, those orders are also subject to these terms and conditions.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

These terms and conditions govern Make Me Smile Balloons and Events including www.makemesmileballoons.com performance relating to the sale and supply of goods to the customer. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Contract with customer

The contract between Make Me Smile Balloons and the customer comes into existence when Make Me Smile Balloons and Events accept the customer’s order i.e. when payment or a deposit for future work has been received. Make Me Smile Balloons and Events is entitled to withdraw from contracts in the case of obvious errors or inaccuracies appearing on the Make Me Smile Balloons and Events web site whether they are as a result of typing, arithmetical or other types of inaccuracies.

Pricing and Availability

The price of the goods are those specified on Make Me Smile Balloons and Events web site or those specified during discussion with authorised representatives from Make Me Smile Balloons and Events. The prices displayed are inclusive of VAT (at the standard UK rate). There may be an additional charge for delivery. Orders are subject to availability. In the unlikely event that the goods are unavailable, the customer will be notified as soon as possible by Email. Price and availability information is subject to change without notice.

Delivery of Goods

Make Me Smile Balloons and events will deliver the goods ordered to the delivery address supplied by the customer. Availability permitting, all orders paid for by debit or credit card will be delivered, where required, within 7 working days. Orders paid for by cheque require 3 days for clearance and are then dispatched in the same way. Make Me Smile Balloons and Events is entitled to deliver in part. Dispatch of goods constitutes fulfilment of contract. Make Me Smile Balloons and Events cannot be held responsible for delays caused by events outside of our control, e.g. postal strike. Once a delivery has been signed for at the address specified on the original order, Make Me Smile Balloons and Events will no longer be responsible and refunds will not be given if the goods do not pass onto the named recipient.

Make Me Smile Balloons and Events Warranty

If the goods delivered are of incorrect quantity, or are damaged or defective, Make Me Smile Balloons and Events will, if the customer returns them 5 days, at the customer’s option either give a full refund or where possible make good any shortage or non-delivery or replace any damaged or defective goods. All packaging and contents of the carton must be returned to us for inspection.

In the event of a claim, settlement will be limited to the value of the goods, if defective or damaged and will in now ay extend to consequential loss, howsoever caused.

Cancellation of Orders

Orders up to the value of £25

Orders may be cancelled up to 2 days prior to the requested delivery date. A full refund minus a 25% administration fee will be issued within 30 days of cancellation. However, once the goods have been dispatched, Make Me Smile Balloons will be exempt from giving cancellation rights.

Orders over the value of £25

Orders may be cancelled. The following cancellation policy applies:

Orders cancelled prior to 12 months from required date – 25% of overall fee to be paid by customer

Orders cancelled prior to 6 months from required date – 50% of overall fee to be paid by customer

Orders cancelled prior to 3 months from required date – 75% of overall fee to be paid by the customer

Orders cancelled within 3 months of required date – 100% of overall fee to be paid by the customer

In the unlikely event that Make Me Smile Balloons are unable to make it to your venue, e.g. in the case of severe weather conditions, a full refund will be issued to the customer.

Deposits

Deposits, irrespective of the amount paid are non refundable unless the contract is broken by Make Me Smile Balloons and Events.

Deposits, for orders made via any other mechanism, irrespective of the amount paid are non refundable after the 7 day ‘cooling off’ period, unless the contract is broken by Make Me Smile Balloons and Events

Where a deposit is refundable within the 7 day period, a full refund will be issued within 30 days of cancellation by the customer.

Hire Items

Any hire items remain the property of Make Me Smile Balloons and Events at all times.

Any deposit taken to protect breakages, damages or loss to or of hire items will be refunded to the customer within 30 days of the return of the goods and only once the goods have been fully inspected by Make Me Smile Balloons and Events.

The amount of the deposit required will vary depending upon the value of hired goods.

Hired items may be subject, at the discretion of Make Me Smile Balloons Events, to an additional delivery charge.

Warning

Balloons and other gifts supplied by Make Me Smile Balloons are not, unless specified, suitable for children under 36 months. Please note, balloons are not toys and children must be supervised at all times.

Where food goods are supplied, Make Me Smile Balloons and Events are not liable for any inappropriate consumption by the customer or their guests.

Make Me Smile Balloons and Events cannot be held responsible for injury or accidents caused by the breach of this warning.

Disclaimer

Make Me Smile Balloons and Events hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regard to the Material and any goods and services supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose).
